I have paid off my loan can I still claim ?

You can still claim. As a general rule the PPI associated with any loan or credit card which was active in the last six years can be claimed back.

How many claims can I make?

You can claim for each loan and credit card for which you have paid PPI. It is common to have had more than one PPI agreement.

How long will my PPI claim take?

On average claims are settled between 3 and 5 months. Some cases may take longer if they are complex.

What happens next?

We will have a short telephone discussion with you following which we will send you a claims form for your signature. Once you return this to us we can progress your claim without delay.

Did I have PPI?

Check your loan and credit card agreements. If it included terms such as Loan Protection, Mortgage Protection Insurance, Accident Sickness Cover, Unemployment Cover, Credit card Repayment Protection you have had a PPI agreement and you may have a strong claim for repayment.

How much are the costs and fees?

We will assess your claim and if you have grounds to claim McHale-Muldoon will fully fund your claim. If your claim is unsuccessful you will not have to pay us any fees.

If your case is successful, you will be liable to pay


  1. Our costs
  2. Disbursements

If your case is successful there is a possibility that you may be liable to pay the Defendant’s costs but this is highly unlikely.

If your case is unsuccessful at court it is possible that you will be liable to pay the Defendant’s costs.

What do we charge?

We will supply you with details of costs as soon as we can. We will inform you of any fixed charges or where this is not possible we will provide an estimate of charges.

An estimate of charges are calculated by:


  1. The complexity and urgency of the case
  2. The complication or uniqueness of the questions raised
  3. The knowledge and responsibility involved
  4. The number of documents prepared or examined
  5. The value of any transaction involved
  6. Time spent on the case
  7. Circumstances in which the case is pursued

You will also be responsible for payment of any disbursements such as a request for documents from your lender.

Who pays our costs?

If we represent you in a case the law requires that unless otherwise agreed, when we send you an invoice for payment of costs, you are responsible for the payment of that invoice.

You will be responsible for our costs even if you win a settlement and a term of that settlement is that our costs will be paid.

You will be responsible for our costs where the defendant is ordered by a court to pay our costs. However, we will seek to recover the costs from the defendant.

If we recover our costs from the defendant and you have already paid our costs in full we will refund the amount paid by you.

The amount which the defendant may agree or may be ordered to pay will not always be sufficient to cover our entire costs. If the costs recovered from the defendant do not cover our costs, then you are obliged to make up the shortfall.

When will I be liable to pay the costs of the Defendant?

If your case is unsuccessful at trial in the majority of cases the court will order you to pay the costs of the Defendant. Even if we believe that you have a strong case and you are successful in court you may still be liable to pay the costs of the Defendant if the court orders in exceptional circumstances. However, we may be able to source on insurance policy for you to insure you against this risk.

What other expenses are involved?

Your case may incur costs for disbursements including a request for documents from your lender, stamp duty on the proceedings and Counsels fees. The outlay is usually about €50.00.per case but in cases which go to court can be much more. If your claim is successful we can usually recover the disbursements from the Defendant. You can pay the disbursements throughout the duration of case and will receive a refund of the recoverable portion if your claim is successful. Alternately we will pay the disbursements on your behalf and a case handling fee will be charged on conclusion of your case.

Will I have to close my credit card account?

No. If we are successful in reclaiming your payment protection insurance back you will not have to close your account with your lender.

Will I have to close my loan account?

No. Payment Protection Insurance is separate from your loan agreement and the loan company cannot insist that you have PPI
